Terms & Conditions
Last updated: August 2026 · Governing law: India
For the AskIt e-pharmacy intermediary & WhatsApp order-facilitation platform. These Terms cover the website, the WhatsApp Bot, and orders fulfilled by licensed partner pharmacies.
These Terms and Conditions ("Terms") govern your access to and use of the AskIt website, our WhatsApp-based interactive conversational service ("WhatsApp Bot"), and any related order-routing or communication services. By using our website, interacting with our WhatsApp Bot, or placing an order through our partner network, you ("User", "Customer", "You") agree to be legally bound by these Terms. If you do not agree, please refrain from using our services.
1.Role of the platform & legal intermediary status
- Intermediary status. AskIt operates purely as a digital aggregator, technology enabler and facilitator connecting end-customers with licensed retail pharmacies ("Partner Pharmacists"). The platform functions as an "Intermediary" as defined under Section 2(1)(w) of the Information Technology Act, 2000.
- No direct sales. AskIt does not own, manufacture, store, stock, inventory, sell or dispense any medicines or medical products. All product sales, prescription verification, clinical validation and drug dispensation are conducted independently by licensed Partner Pharmacists registered under the Drugs and Cosmetics Act, 1940 and the Drugs and Cosmetics Rules, 1945. The sale of medicine is a contract between you and the Partner Pharmacist who fulfils your order.
2.Eligibility
- You must be 18 or older and ordering for lawful personal or household use.
- You must provide accurate delivery details. We deliver only to serviceable areas, confirmed at the time of ordering.
3.Prescriptions & statutory compliance
- Prescription requirements. In accordance with the Drugs and Cosmetics Rules, 1945, a valid original prescription issued by a Registered Medical Practitioner (RMP) in India is strictly required for all Schedule H, Schedule H1 and other prescription-only drugs. When prompted, upload a clear, legible photo or PDF of the prescription via the WhatsApp Bot.
- You confirm any prescription you upload is genuine, issued to the patient named, and currently valid. The Partner Pharmacist may decline the order or seek clarification at their professional discretion.
- We do not provide medical advice — always follow your doctor's instructions.
4.Banned & illegal substances
In compliance with the Drugs and Cosmetics Act, 1940, rules enforced by the Central Drugs Standard Control Organization (CDSCO) and Ministry of Health directives, the platform strictly prohibits orders for:
- Schedule X drugs (narcotics, psychotropic drugs, mind-altering tranquilizers);
- Habit-forming or addictive substances;
- Unlicensed, unapproved or banned Fixed-Dose Combinations (FDCs);
- Emergency or institutional hospital-only critical-care medicines.
5.How pricing works
- Partner Pharmacists quote the price of your medicines. You see the itemised quote before paying and choose whether to proceed.
- A flat convenience fee of ₹30 per order is charged by AskIt and is shown separately in your quote before payment.
- Any delivery charge, where applicable, is included in the quote you approve.
- All amounts are in Indian Rupees and inclusive of applicable taxes (GST) unless stated otherwise. There are no hidden charges.
6.Orders, payment & delivery confirmation
- Payment methods. Payments may be processed through integrated third-party secure payment gateways (supporting UPI, Credit/Debit Cards and Net Banking) or via Cash/UPI on Delivery, depending on regional availability and Partner Pharmacist fulfilment capabilities.
- Where prepayment applies, an order is confirmed only when payment succeeds against the payment link we send you. For Cash/UPI on Delivery, the order is confirmed when you approve the quote in the chat.
- OTP delivery confirmation. Delivery is completed by handing the order to you or your representative at the delivery address, confirmed by a one-time code (OTP) shared in your WhatsApp chat. Do not share that code with anyone except the person delivering your order.
7.Cancellations
- By you. You may cancel free of charge at any time before the Partner Pharmacist verifies the uploaded prescription and dispatches the consignment. Once the package is marked "Out for Delivery", cancellations are generally not permitted.
- By the platform or pharmacist. An order may be cancelled unilaterally, without financial penalty to the platform or pharmacist, in cases of: (a) inability to verify a valid original prescription issued by an RMP; (b) non-availability of requested stock; (c) requests for illegal, banned or habit-forming substances; or (d) unserviceable delivery locations.
Full details, including how refunds interact with cancellation: see our Refund & Cancellation Policy, which forms part of these Terms.
8.Refunds
- Refunds are processed only if: (a) the order was cancelled prior to dispatch; (b) the delivered consignment is visually damaged, expired or incorrect upon delivery; or (c) the Partner Pharmacist fails to fulfil an accepted order.
- Approved refunds are credited back to your original payment source within 5 to 7 business days, subject to standard interbank and payment-gateway settlement cycles.
9.Delivery from pharmacist to customer
- Fulfilment responsibility. The physical sale, quality assurance, packaging and dispatch of all pharmaceutical items are executed directly by the designated licensed Partner Pharmacist.
- Delivery logistics. Deliveries may be carried out by delivery executives employed by the Partner Pharmacist or through third-party hyper-local logistics services engaged by the Partner Pharmacist.
- Tamper-evident packaging. Medicines are delivered in sealed, tamper-evident packaging. Inspect the package upon arrival and refuse acceptance if the seal is broken, damaged or altered.
- Delivery verification. For cold-chain storage medicines or regulated drugs, the delivery personnel or Partner Pharmacist may request physical verification of the original prescription or customer identity proof before hand-over.
10.Accuracy of your address
- You are solely responsible for providing complete, accurate and current delivery information — full address, flat/house number, landmark, pin code, and an active primary WhatsApp/mobile number.
- Neither the platform nor the Partner Pharmacist is liable for non-delivery, delays or wrong deliveries caused by incorrect or incomplete address inputs, customer unavailability, or restricted premise access.
- If a delivery attempt fails due to incorrect address information or refusal to accept without valid justification, additional re-delivery fees may be charged prior to re-dispatch.
11.Acceptable use
Do not submit false prescriptions, another person's details, or fraudulent orders. Do not attempt to obtain habit-forming, narcotic or otherwise restricted substances contrary to law. We may refuse, limit or cancel orders, and may block access we reasonably believe is being misused.
12.Disclaimer & limitation of liability
The platform does not provide medical diagnosis, clinical advice or treatment options. All content on the website or WhatsApp Bot is for informational purposes only — always consult a qualified medical doctor for medical concerns. We are responsible for operating the platform with reasonable care; we assume no liability for adverse drug reactions, dosage errors, or fulfilment errors attributable to Partner Pharmacists, for a prescriber's advice, or for indirect or consequential loss. Nothing here limits liability that cannot be limited under applicable law, including the Consumer Protection Act, 2019.
13.Changes & governing law
We may update these Terms; the "last updated" date above will change, and continued use means acceptance. These Terms are governed by the laws of India, and the courts at Gurugram, Haryana have exclusive jurisdiction.
